RFM Wins on Appeal Before Utah Records Committee!
Just had the hearing.
We won!
The Utah Records Committee just voted unanimously that the BYUPD improperly classified the police reports AND the audio tapes of the interviews as not subject to GRAMA.
Judge Laura Scott has still not issued her ruling in the other case on appeal before her, and this decision by the Records Committee is subject to her ruling that BYUPD is a governmental agency and is therefore subject to GRAMA.
Which is what everybody, including the five-member State Records Committee, understands she is going to do.

How is the ruling that the tapes are not subject to GRAMA a win?consiglieri wrote: ↑Thu Jul 12, 2018 1:20 pm Just had the hearing.

Good faith does not require evidence, but it also does not turn a blind eye to that evidence. Otherwise, it becomes misplaced faith.

An eight minute episode of RFM just went up in which the entire hearing is captured for the record.

I think it is pretty amusing, if I do say so myself!

Great stuff - can't wait to hear the interview with McKenna. Some great work, consiglieri!

One question here.
Other than being required to release properly redacted copies of the materiel in question, will there be any other repercussions for the BYUPD for not following state law?

Not if they promptly release the records ordered by the Committee.Just This Guy wrote: ↑Thu Jul 12, 2018 8:45 pm One question here.

In some states, governmental agencies can get fined a penalty per day for not releasing records prior to appellate review, but I don't see that in the GRAMA statute.
If they continue to refuse without appealing, however, there could be monetary ramifications.

Is there any chance that the released evidence might be incomplete, as in, "well, here it is. We know you expected more but this is all we can find."

This is good. The Church would like to turn Utah, but especially B.Y.U. into it own little country, just like Joseph Smith wanted to do with Nauvoo. I'm glad to see that not everybody goes along with that.
God is Love. God is Truth. The greatest problem with organized religion is that the organization becomes god, rather than a means of serving God.

Would the Church's next level of appeal be to the Utah State Supreme Court?Advocate wrote: ↑Fri Jul 13, 2018 12:27 pm The ruling came out today, BYU lost. BYU PD is subject to GRAMA:

This is great - you'd think the one true church would be happy with transparency, but glad we'll get a little bit of it one way or another.Advocate wrote: ↑Fri Jul 13, 2018 12:27 pm

I am seeing that Judge Scott released her detailed ruling yesterday, according to the SLT. Anyone have a link? I can't find the actual text of it.
